TERMS OF SERVICE

These Terms of Service (“Terms”) govern all services provided by Foothills Home Design LLC, a Colorado limited liability company (“Company,” “we,” “us,” or “our”), to any client (“Client,” “you,” or “your”). By engaging our services, visiting our website, or signing a Service Agreement that incorporates these Terms by reference, you agree to be bound by these Terms.

1. Services

Foothills Home Design LLC provides residential design consulting services, including but not limited to:

  • Interior layout planning

  • Conceptual design

  • 3D modeling and renderings

  • Non-structural drawings

  • Design visualization

  • Space planning and material concepts

All services are conceptual and visual in nature unless otherwise expressly stated in writing.

2. No Architectural or Engineering Services

The Company is not a licensed architecture or engineering firm.

We do not provide:

  • Structural engineering

  • Load-bearing analysis

  • Code compliance verification

  • Permit-ready construction documents

All drawings, renderings, and layouts are conceptual only and must be reviewed, verified, and approved by licensed professionals and/or contractors before construction.

3. Client Responsibilities

Client agrees to:

  • Provide accurate measurements, site access, and information

  • Confirm dimensions and conditions with contractors

  • Obtain all permits and approvals

  • Retain licensed contractors for construction

  • Review and approve designs prior to use

The Company is not responsible for errors resulting from inaccurate or incomplete information provided by the Client.

4. Revisions

Unless otherwise stated in a written Service Agreement:

  • Services include up to two (2) rounds of reasonable revisions

  • Additional revisions are billed at the Company’s then-current hourly rate

  • Major scope changes require a new agreement or written amendment

5. Fees and Payment

  • Fees are outlined in the applicable Service Agreement

  • Payment terms are net as stated

  • Late payments may result in suspension of services

  • All payments are non-refundable once work has commenced

6. Intellectual Property

All drawings, renderings, layouts, and design materials remain the intellectual property of Foothills Home Design LLC until full payment is received.

Upon full payment:

  • Client receives a non-exclusive, non-transferable license to use the deliverables solely for the agreed project

  • Client may not resell, reproduce, or distribute designs without written permission

7. Photography & Portfolio Use

The Company may photograph, display, and reference completed or conceptual work for:

  • Portfolio

  • Website

  • Marketing materials

  • Social media

Client may opt out in writing prior to project commencement.

8. Limitation of Liability

To the maximum extent permitted under Colorado law:

  • The Company’s total liability for any claim shall not exceed the total fees paid for the services giving rise to the claim

  • The Company is not liable for indirect, incidental, consequential, or special damages

  • The Company is not responsible for contractor errors, construction defects, cost overruns, delays, or code violations

9. Indemnification

Client agrees to indemnify and hold harmless Foothills Home Design LLC from any claims, damages, or expenses arising from:

  • Use of design materials

  • Construction activities

  • Contractor performance

  • Client misuse of deliverables

10. No Guarantee

Design outcomes are subjective. The Company makes no guarantees regarding:

  • Aesthetic preferences

  • Construction cost accuracy

  • Final appearance

  • Contractor interpretation

11. Termination

Either party may terminate services upon written notice.
Client remains responsible for payment of all work performed through the termination date.

12. Dispute Resolution

Any dispute arising from these Terms or services provided shall be:

  • Governed by Colorado law

  • Resolved exclusively in Larimer County, Colorado

  • Subject to binding mediation or arbitration, at the Company’s discretion

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

14. Modifications

The Company may update these Terms from time to time.
The version in effect at the time services are rendered shall govern.
