FOOTHILLS HOME DESIGN LLC
TERMS OF SERVICE Effective Date: February 2, 2026
These Terms of Service (“Terms”) govern all services provided by Foothills Home Design LLC, a Colorado limited liability company (“Company,” “we,” “us,” or “our”), to any client (“Client,” “you,” or “your”). By engaging our services or signing any agreement that references these Terms, you agree to be bound by them.
1. Services
Foothills Home Design LLC provides residential services including, but not limited to:
Interior design and visualization
Finish carpentry (trim, doors, etc.)
Window and door replacement
Tile installation
Non-structural framing
Demolition and preparation work
Material sourcing and coordination
General renovation support and design-build services
Services may be provided directly to homeowners or in collaboration with contractors and other trades, depending on the needs of the project.
2. Project Roles & Coordination
Foothills Home Design works flexibly depending on the needs of each project. Services may be provided directly to homeowners or in collaboration with general contractors and other trades.
For some projects, the Company may assist with coordination, planning, and execution of specific scopes of work. For others, the Company may operate as part of a broader project team.
The Client acknowledges that:
The Company’s role is limited to the specific services agreed upon
Other contractors or trades may be engaged independently by the Client or others
Each party is responsible for their own scope of work
Clear communication and coordination between all parties is essential to a successful project, and the Company will work in good faith to support that process.
3. Permits & Compliance
Residential renovation projects may require permits or approvals depending on the scope of work.
Unless otherwise agreed in writing:
Permits are typically obtained by the homeowner or a licensed contractor overseeing the project
The Company performs work consistent with the agreed scope and standard residential practices
If permit requirements arise during the course of a project:
The scope, timeline, and responsibilities may be adjusted accordingly
The Company does not provide formal code compliance review or assume responsibility for permitting unless explicitly included in the project scope, but will communicate openly and help guide Clients toward appropriate next steps when needed.
4. Existing Conditions & Unknown Issues
Remodel and renovation work involves inherent uncertainty.
The Company is not responsible for pre-existing or hidden conditions, including but not limited to:
Structural deficiencies
Water damage, rot, or mold
Electrical or plumbing issues
Prior code violations
If such conditions are discovered, work may be paused and additional costs or scope adjustments may be required.
5. Materials
Materials may be:
Purchased by the Company and reimbursed by the Client, or
Purchased directly by the Client
Client acknowledges that:
Material costs may vary
Availability and lead times are outside the Company’s control
Manufacturer defects are not the responsibility of the Company
6. Payment Terms
Unless otherwise stated in writing:
Material costs are due upfront
Fifty percent (50%) of labor is due prior to commencement
The remaining balance is due upon completion
Failure to make timely payments may result in suspension of work and project delays. All payments are non-refundable once work has commenced.
7. Change Orders
Changes to scope, materials, or design may result in additional costs and timeline adjustments. Changes must be approved before additional work proceeds.
8. Scheduling & Delays
Project timelines are estimates and may be affected by:
Weather
Material availability
Site conditions
Client responsiveness
Coordination with other trades
The Company is not responsible for delays outside its control.
9. Client Responsibilities
Client agrees to:
Provide safe and reasonable access to the worksite
Ensure utilities are available as needed
Remove or protect personal belongings
Coordinate with other contractors where applicable
Make timely decisions to avoid delays
10. Workmanship Warranty
The Company provides a one (1) year limited workmanship warranty covering defects in workmanship only.
This warranty:
Is non-transferable
Is limited to repair or correction of the original work
This warranty does not cover:
Normal wear and tear
Material defects
Damage caused by others
Improper use or maintenance
11. Limitation of Liability
To the maximum extent permitted under Colorado law, the Company’s total liability for any claim shall not exceed the total amount paid for the specific work giving rise to the claim.
The Company is not liable for indirect, incidental, or consequential damages, including but not limited to loss of use, property damage beyond the scope of work, cost overruns, or work performed by other contractors or trades not under the Company’s control.
12. Indemnification
Client agrees to indemnify and hold harmless the Company from claims arising from:
Work performed by other contractors
Client-provided materials
Site conditions outside Company control
Use or misuse of completed work
13. Photography & Portfolio Use
The Company may photograph and use project images for portfolio and marketing purposes unless the Client opts out in writing prior to project commencement.
14. Termination
Either party may terminate services upon written notice. Client remains responsible for payment for all work performed and materials purchased or committed prior to termination.
15. Dispute Resolution
Any dispute arising from these Terms or services provided shall be governed by the laws of the State of Colorado and resolved in Larimer County, Colorado.
16. Modifications
The Company may update these Terms from time to time. The version in effect at the time services are performed shall apply.
